Terms Of Service

These Terms of Service govern all sales made on the website www.weartheclothes.com. In accordance with applicable Dutch and European Union consumer protection laws, they set out the rights and obligations of both Wear The Clothes and its customers.

Article 2 – Products

The essential characteristics of each product are presented on the product page. Photographs are for illustrative purposes only and are not contractually binding. Products are offered while stocks last.

Article 3 – Prices

Prices are listed including all applicable taxes (VAT). Shipping costs are clearly stated before order confirmation. Wear The Clothes reserves the right to modify prices at any time.

Article 4 – Orders

By placing an order, the customer accepts these Terms of Service in full. A confirmation email is sent to the address provided at checkout.

Article 5 – Payment

Payments are processed securely online via Visa, Mastercard, PayPal, iDEAL, or Shop Pay. All transactions are encrypted and handled by certified secure platforms.

Article 6 – Delivery

Orders are processed within 24 business hours. Delivery times communicated at checkout are indicative. In the event of a delay exceeding 30 days, the customer may request order cancellation. Risk transfers to the customer upon receipt of the order.

Article 7 – Right of Withdrawal

In accordance with EU Directive 2011/83/EU and the Dutch Civil Code (Article 6:230o BW), customers have 14 calendar days from receipt of their order to exercise their right of withdrawal, without giving any reason. As a commercial gesture, Wear The Clothes extends this period to 30 calendar days.

Items must be returned unused, unworn, and in their original packaging with all tags attached. Return shipping is the customer's responsibility, unless the item is defective or sent in error. Final sale items, customized pieces, and intimate apparel (once unsealed) are not eligible for return, in line with Article 6:230p BW.

Article 8 – Return and Refund Procedure

To initiate a return, customers must contact our customer service at info@weartheclothes.com. Refunds are processed within 14 calendar days after the returned product has been received and inspected, using the original payment method.

Article 9 – Legal Warranties

All products are covered by the legal warranty of conformity under Dutch law (Article 7:17 BW) and applicable EU consumer protection regulations. In the event of a non-conforming or defective product, the customer is entitled to repair, replacement, or a refund.

Article 10 – Liability

Wear The Clothes cannot be held liable for indirect damages resulting from the use of products sold. In any event, liability is limited to the amount of the order.

Article 11 – Personal Data Protection

Personal data is collected solely for order processing, customer service, and — with prior consent — marketing communications. Our site complies with the General Data Protection Regulation (GDPR) – Regulation (EU) 2016/679. Article 12 – Use of Cookies

Cookies may be used to improve browsing experience, measure traffic, and deliver personalized content. Users can manage their preferences through the cookie banner at any time.

Article 13 – Dispute Resolution

In the event of a dispute, customers are encouraged to first contact us directly so we can find an amicable solution. If no agreement can be reached, customers within the EU may use the European Commission's online dispute resolution platform: https://ec.europa.eu/consumers/odr.

Article 14 – Intellectual Property

All elements of the website (text, images, design, logo) are the exclusive property of Wear The Clothes. Any reproduction, in whole or in part, is strictly prohibited without prior written consent.

Article 15 – Governing Law and Jurisdiction

These Terms of Service are governed by Dutch law. Any disputes shall fall under the exclusive jurisdiction of the competent Dutch courts, without prejudice to mandatory consumer protection rights granted by the law of the customer's country of residence.
